Data Collection: Verdek may collect anonymized data regarding your usage of Verdek-enabled charging stations. For information on how personal and usage data is collected, stored, and used, please refer to our Privacy Policy.

Fees and Payments: You agree to pay all applicable fees (“Fees”) charged by Verdek and/or property hosts where Verdek charging stations are installed. Payments may be made using a credit card, RFID card, code, mobile application, or via customer support. You are responsible for keeping your account information, including billing details, accurate and up to date. Payment disputes must be submitted in writing to support@verdek.com within 60 days of the charge. Failure to do so waives your right to dispute the charge.

Use of Charging Stations: You must only use manufacturer-approved adapters when using Verdek charging stations. Third-party adapters are strictly prohibited and may cause damage or safety hazards. You are solely responsible for any harm caused by using unauthorized equipment and agree to indemnify Verdek for related claims or losses.

Billing: All usage fees are determined by location and configuration, including:

• Per kilowatt-hour (kWh)
• Per minute or hourly rates
• Session-based flat fees
• Idle or overstay penalties

Pricing details will be displayed on-site or via the Mobile App. Prepaid account options are available, and authorization holds may appear on your credit card. Failure to pay may result in account suspension or assignment to collections.
If your RFID card is lost or stolen, notify Verdek immediately through your online account or by contacting support.

Promotional Offers: Verdek may offer promotional plans or discounts (“Offers”) at our discretion. Eligibility is determined by Verdek and may be revoked for non-compliance. Offer terms may change with 30 days’ notice. Continued use implies acceptance of any changes.

Website, Portal, and App Use: You may access Verdek’s Website, Client Portal, and Mobile App to locate charging stations and manage your account. Verdek may modify these platforms at any time. While we strive for accuracy, we make no guarantees regarding the timeliness or correctness of the content provided.

Termination: You or Verdek may terminate this Agreement at any time. Upon termination, you remain responsible for any unpaid Fees. Misuse, fraud, or violations of these Terms may result in immediate termination without refund.

Limitation of Liability: To the maximum extent permitted by law, Verdek and its affiliates will not be liable for indirect, incidental, punitive, or consequential damages arising from use of the Services. In any event, our total liability shall not exceed the total amount of Fees you paid in the six (6) months preceding the claim.

Indemnification: You agree to indemnify and hold harmless Verdek, its officers, partners, employees, and agents from all claims arising from your use of the Services, misuse of equipment, or breach of these Terms.

Disclaimer of Warranties: Services are provided “as is” and “as available.” Verdek disclaims all express or implied warranties, including warranties of merchantability and fitness for a particular purpose.

Class Action Waiver: You agree not to bring claims against Verdek as part of a class or representative action and instead agree to pursue individual arbitration for disputes.

Entire Agreement: These Terms, along with any referenced policies, constitute the entire agreement between you and Verdek concerning your use of the Services.
